GENERAL TERMS AND CONDITIONS OF SALE UNITED COLORS OF BALI.COM
1 — Purpose
These terms and conditions of sale govern the contractual relationship between UNITED COLORS OF BALI.COM and the buyer, and apply to purchases made through the UNITED COLORS OF BALI.COM website, whether the buyer is a professional or a consumer.
The purchase of a good or service through this site implies the buyer’s unreserved acceptance of these terms and conditions of sale.
These terms and conditions of sale shall prevail over any other general or specific terms not expressly agreed to by UNITED COLORS OF BALI.COM.
UNITED COLORS OF BALI.COM reserves the right to modify its terms and conditions of sale at any time. In such cases, the applicable terms will be those in effect on the date of the buyer’s order.
2 — Characteristics of the goods and services offered
The products and services offered are those listed on the UNITED COLORS OF BALI.COM website.
These products and services are offered subject to availability.
The product descriptions provided by UNITED COLORS OF BALI.COM are as accurate as possible but cannot in any case be a perfect match to the product sold, particularly with regard to colors, surface areas, furnishings, orientations or views, etc.
3 — Prices
The prices listed on the site are per-villa prices in € (euros), $ (USD), or Rupiah (IDR), taxes and service included. The prices charged apply only to the services strictly specified in the booking. They are valid for the period displayed and may be changed without notice; only the price stated in the booking confirmation is contractually binding.
Prices do not include the buyer’s additional consumables (drinks, breakfasts, snacks, etc.), which must be paid for on site.
Unless expressly stated otherwise, prices also do not include the tourist levy owed by foreign visitors to the Province of Bali (Pungutan Wisatawan Asing — PWA), described in Article 18 below.
4 — Online ordering
When placing an order, the buyer must:
– complete the identification form, providing all requested details,
– complete the online order form, giving all references for the products or services chosen,
– confirm the order after reviewing it,
– make payment under the conditions provided,
– confirm the order and payment.
Confirmation of the order constitutes acceptance of these terms and conditions of sale, acknowledgment of having fully understood them, and a waiver of the right to rely on the buyer’s own purchasing conditions or any other conditions.
All data provided and the confirmation recorded shall constitute proof of the transaction. Confirmation shall be equivalent to a signature and acceptance of the transactions carried out.
UNITED COLORS OF BALI.COM will send confirmation of the recorded order by email.
5 — Confirmation
A villa booking with UNITED COLORS OF BALI.COM is only valid once confirmed by UNITED COLORS OF BALI.COM. Multiple bookings are not subject to these general terms and conditions of sale but to the terms of a separate group contract.
A booking is considered “multiple” when it covers 4 villas or more, OR 15 people or more, made by the same legal entity or individual.
The booking will only become effective upon receipt of the deposit. UNITED COLORS OF BALI.COM reserves the right to refuse any incomplete booking.
Full prepayment of the stay (non-refundable) will be requested when the booking is registered.
6 — Villa availability
Villas are available from 3:00 p.m. on the day of arrival and must be vacated by 12:00 p.m. on the day of departure; beyond this time, an additional night will be charged.
7 — Full cancellation terms
If the tenant needs to cancel their booking, they must notify UNITED COLORS OF BALI.COM in writing (email) as soon as possible.
The terms for a full cancellation of the stay depend on the total length of the stay originally booked:
– More than 14 days before arrival: the deposit will be refunded (excluding administrative fees and bank transfer charges)
– Less than 14 days before arrival: 100% charged
8 — Partial cancellation terms
A partial cancellation of the booking is considered any change to the date, length of stay, or type of villa originally confirmed by UNITED COLORS OF BALI.COM. Any partial cancellation of the booking may result in a change to the rate and payment of the penalties described above.
If the partial cancellation corresponds to a change in the length of stay, this may result in a change in rate. If the new length of stay is shorter than originally booked, the cancellation terms set out in Article 7 will apply. If the length of stay is longer, confirmation will be subject to acceptance by UNITED COLORS OF BALI.COM, subject to availability.
9 — House rules
House rules are posted at the UNITED COLORS OF BALI.COM reception. The guest agrees to keep the property and furnishings provided in the villa in good general condition and must report any defect or malfunction to reception.
UNITED COLORS OF BALI.COM reserves the right to enter the villas to carry out housekeeping and to check the general condition and safety conditions of the villas.
In the event of a guest’s failure to meet the obligations set out herein, or failure to comply with the house rules, UNITED COLORS OF BALI.COM reserves the right to cancel their stay.
The buyer and their companions further agree to comply with the customs and rules applicable to foreign visitors in Bali (appropriate dress, respect for sacred sites, ceremonies, and local customs).
10 — Relocation
In the event of force majeure (strike, war, flooding, etc.), an exceptional event, or technical issues at UNITED COLORS OF BALI.COM making the guest’s stay impossible, UNITED COLORS OF BALI.COM will do everything possible to find alternative accommodation, if possible in a hotel or similar establishment of the same category. Relocation costs (rate supplement) and transfer costs will be covered by UNITED COLORS OF BALI.COM, except in the case of force majeure as mentioned above. UNITED COLORS OF BALI.COM shall not be liable for any additional compensation in this respect.
11 — Local disruptions
In the event of force majeure or unforeseeable circumstances, UNITED COLORS OF BALI.COM cannot be held responsible for disturbances that disrupt, interrupt, or prevent your stay (drought, flooding, oil spill, general power, gas or water outage, strikes, construction work, etc.). “Construction work” generally refers to road or building construction that may take place near your place of stay. UNITED COLORS OF BALI.COM cannot be held liable for the acts of third parties with whom it has no contract. No recourse is possible in such cases.
12 — Insurance – Liability
UNITED COLORS OF BALI.COM disclaims all liability in the event of theft, loss, or damage to guests’ belongings during their stay. The guest will be held liable for any damage, deterioration, or act of vandalism that may occur as a result of occupying the premises and/or as a result of the participants and/or staff for whom they are responsible, whether to furniture, decorative items, or property belonging to UNITED COLORS OF BALI.COM or not.
In the online booking process on our website, we cannot be held liable for any damage resulting from the use of the Internet, such as data loss, viruses, service interruption, or other unintentional issues. The tenant is required to insure the villa rented to them. They must therefore check whether their primary home insurance policy includes a “vacation rental” extension. If not, they must contact their insurance company and request an extension of coverage, or take out a specific policy under a “vacation rental” clause. Proof of insurance may be requested upon check-in; otherwise, the tenant certifies on their honor, upon signing the specific terms, that they have taken out such a policy.
13 — Recommendations
The guest agrees not to invite any person whose behavior could be detrimental to the establishment; UNITED COLORS OF BALI.COM reserves the right to intervene if necessary.
14 — Protection of personal data
As part of booking management, UNITED COLORS OF BALI.COM collects and processes personal data concerning the buyer (identity, contact details, payment information, stay preferences and, where applicable, a copy of an identity document required upon arrival).
This processing is carried out in accordance with Law No. 27 of 2022 on Personal Data Protection (Undang-Undang Pelindungan Data Pribadi — UU PDP), Law No. 19 of 2016 amending Law No. 11 of 2008 on Electronic Information and Transactions (UU ITE), and Article 59 of Government Regulation No. 80 of 2019 on Trade through Electronic Systems (PP PMSE).
Processing is based on the buyer’s consent, given upon acceptance of these terms, as well as on the performance of the booking contract. Data is collected fairly, used solely for the purposes of the booking and stay, stored securely for as long as necessary for these purposes, and disclosed to third parties only to the extent useful for fulfilling the booking (local service providers, banking institutions) or in fulfillment of a legal obligation under Indonesian law.
In accordance with the UU PDP law, the buyer has the right to access, rectify, erase, and withdraw consent regarding their personal data, which they may exercise by writing to (email or postal address of the data controller to be completed by UNITED COLORS OF BALI.COM).
15 — Intellectual property
All elements of the UNITED COLORS OF BALI.COM website are and remain the exclusive intellectual property of UNITED COLORS OF BALI.COM.
No one is authorized to reproduce, exploit, redistribute, or use in any way whatsoever, even partially, any elements of the site, whether software, visual, or audio.
Any simple or hypertext link is strictly prohibited without the express written consent of UNITED COLORS OF BALI.COM.
This protection is based in particular on Law No. 28 of 2014 on Copyright (Undang-Undang Hak Cipta).
16 — Partial invalidity
The invalidity of one or more articles of these General Terms and Conditions of Sale shall not render the entirety of these terms invalid; any article deemed, in whole or in part, illegal, void, invalid, or unenforceable under applicable laws and regulations shall be amended to the minimum extent necessary to render these Terms valid and enforceable.
All other provisions herein shall remain applicable and shall take full effect.
17 — Jurisdiction
Disputes arising from the application or interpretation of these general terms and conditions of sale shall be governed by Indonesian law and shall fall under the exclusive jurisdiction of the Indonesian courts.
It is specified that the territorially competent Indonesian court is that of the jurisdiction where UNITED COLORS OF BALI.COM’s head office is located in Bali (Pengadilan Negeri of Denpasar or Badung, depending on the operating address). Before any legal action, the buyer who is a consumer is invited, should they wish, to resort to the amicable dispute resolution described in Article 19 below.
18 — Bali Province Tourist Levy (Pungutan Wisatawan Asing — PWA)
In accordance with Law No. 15 of 2023 on the Province of Bali and Bali Provincial Regulation (Peraturan Daerah) No. 6 of 2023, as amended by Peraturan Daerah No. 2 of 2025, every foreign tourist entering Bali is liable for a contribution intended for the protection of Balinese culture and the environment (PWA), amounting to Rp 150,000 per person, payable through the official “Love Bali” system (lovebali.baliprov.go.id) before arrival or during the stay in Bali.
This levy is the sole responsibility of the buyer and their companions; it is not included in the rental rates mentioned in Article 3, unless expressly stated otherwise at the time of booking. As the host (“endpoint”), UNITED COLORS OF BALI.COM may assist the buyer in paying this levy, without being obligated to do so, and reserves the right to request proof of payment upon arrival.
19 — Consumer dispute resolution
In accordance with Law No. 8 of 1999 on Consumer Protection (Undang-Undang Perlindungan Konsumen — UUPK), and failing an amicable agreement, any buyer who is a consumer and has not obtained satisfaction directly from UNITED COLORS OF BALI.COM’s customer service may bring the matter before the competent Indonesian courts designated in Article 17, including, where applicable, through the simplified “gugatan sederhana” (small claims procedure) before the competent Pengadilan Negeri.
